Sinclairs Jewellers Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of Sinclairs Jewellers Web Site constitutes your acceptance of, and agreement with Sinclairs Jewellers to, all such terms, conditions, and notices.

2.MODIFICATION OF THESE TERMS OF USE

Sinclairs reserves the right to change the terms, conditions, and notices under which Sinclairs Jewellers Site is offered, including but not limited to the charges associated with the use of Sinclairs Jewellers Site. You are responsible for regularly reviewing these terms and conditions. Your continued use of the Sinclairs Jewellers Site constitutes your agreement with Sinclairs Jewellers to all such terms, conditions, and notices.

3.SECURITY GUARANTEE

Our online payment provider (Secure Trading) uses a secure-server software to encrypt your credit or debit card number and personal details. The encryption process takes the characters you enter and converts them into bits of code that are then securely transmitted over the Internet. We only store your billing and delivery address details to allow faster processing of future orders.We do not sell or lease any of your personal information. All information left with Sinclairs Jewellers is entirely confidential. Credit Card information is not retained and will require re-entry for subsequent purchases.

Your IP is logged when placing an order with Sinclairs Jewellers. This is for reasons of fraud protection. All orders are scanned strictly for fraud by our fraud department before they are shipped. If you specify a different delivery address to the billing address then your order may take longer as we have to perform the necessary checks. Fraudulent or suspicious orders may be disclosed to the appropriate authorities on their legal request.

4.PERSONAL AND NON-COMMERCIAL USE LIMITATION

Unless otherwise specified, the Sinclairs Jewellers Site is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products or services obtained from Sinclairs Jewellers Site. Any dealings with third parties included within Sinclairs Jewellers Site or participation in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between you and the advertiser or other third party. Sinclairs Jewellers shall not be responsible or liable for any part of any such dealings or promotions.

6.NO UNLAWFUL OR PROHIBITED USE

YOU SPECIFICALLY AGREE THAT SINCLAIRS JEWELLERS IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL CONTENT OR CONDUCT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT SINCLAIRS IS NOT RESPONSIBLE FOR ANY CONTENT SENT USING AND/OR INCLUDED IN A SINCLAIRS JEWELLERS SITE BY ANY THIRD PARTY.

TO THE FULLEST EXTENT PERMITTED BY LAW IN NO EVENT SHALL SINCLAIRS JEWELLERS AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA REVENUES OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF SINCLAIRS JEWELLERS SITE, WITH THE DELAY OR INABILITY TO USE SINCLAIRS JEWELLERS SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH SINCLAIRS JEWELLERS SITE, OR OTHERWISE ARISING OUT OF THE USE OF SINCLAIRS JEWELLERS SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF SINCLAIRS JEWELLERS OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF SINCLAIRS JEWELLERS SITE, OR WITH ANY OF THESE TERMS OF USE, TO THE FULLEST EXTENT PERMISSIBLE BY SCOTTISH LAW, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING SINCLAIRS JEWELLERS SITE. THE LIMITATIONS ON AND EXCLUSIONS OF LIABILITY FOR DAMAGES IN THIS AGREEMENT APPLY REGARDLESS OF WHETHER THE LIABILITY IS BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF WARRANTIES, OR ANY OTHER LEGAL THEORY. NOTHING IN THIS AGREEMENT LIMITS SINCLAIRS'S JEWELLERS LIABILITY FOR (II) PERSONAL INJURY OR DEATH

8.ACCURACY OF INFORMATION

Information and prices appearing on the Sinclairs site is believed to be accurate, but neither Sinclairs Jewellers nor its suppliers warrant or guarantee such accuracy.

Sinclairs Jewellers operate with stock levels shared between online and in store. These stock levels are updated frequently every day, however at busier times there may be the rare occasion where the item(s) you have selected are no longer available or your order cannot be placed in the timescale you have selected and a notification email will be sent. With items such as rings it is not possible for Sinclairs Jewellers to stock each style in every available size. If your size is not shown we advise to contact us and we will order the item from the manufacturer where possible.

All prices are not contractually binding. Every effort is made to ensure that prices are as up to date as possible and we will inform you of any discrepancies with a price of any purchase before you are committed to purchase. All information is provided by Sinclairs Jewellers without any representation or warranty as to its accuracy and in no event shall Sinclairs Jewellers be liable in connection with the use of this information unless otherwise stated. All prices are in Pounds Sterling (GBP £) and are inclusive of VAT in the U.K.

You are responsible for paying the entire amount due on your purchase, including any applicable taxes, shipping and other charges.

You represent and warrant that you are at least 18 years of age and that you possess the legal right to use Sinclairs Jewellers Site in accordance with the stated terms and usage policies. You hereby agree to supervise usage by, and be responsible for the actions of, any minors who use your computer to access Sinclairs Jewellers Site.

9.PAYMENT & ORDER ACCEPTANCE

You agree to pay Sinclairs Jewellers all charges at the prices then in effect for any products ordered by you or other persons (including your agents) using your computer, and you authorise Sinclairs Jewellers to charge your chosen payment method (your "Payment Method") for such products. You agree to make payment using that selected Payment Method. Sinclairs Jewellers reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

Currency exchange settlements will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method (the "Payment Method Provider"). If Sinclairs Jewellers does not receive payment from your Payment Method Provider, you agree to pay all amounts due upon demand.

If the amount to be charged to your chosen Payment Method varies from the amount you pre-authorised, you have the right to receive, and Sinclairs Jewellers shall so provide, notice of the amount to be charged and the date of the charge. Any agreement you have with the Payment Method Provider will govern your use of your Payment Method.

Due to the nature of the products which we sell, we operate a strict fraud screening process and therefore we are only able to accept and dispatch your order if is validated by our network easily. In almost all cases, this is a straightforward process and can be completed immediately however in some cases there may be a delay of a few hours while we perform the appropriate checks. All orders are subject to acceptance by Sinclairs Jewellers and we may, at our discretion, refuse to accept your order including where:

  • The information you provided us with your order does not comply with our stringent security checks, is incorrect or mismatched (e.g. the billing information provided does not match that of your bank or building society records)
  • There is an error on our site relating to the item(s) you have ordered (e.g there is an error relating to the price or description of the item(s) chosen)
  • The item(s) you have selected are no longer available through our site
  • We believe you to be under the age of 18 and therefore are not permitted to use the Sinclairs Jewellers site

If we are unable to accept your order for any of the above reasons we will send you an email informing you of the reason for rejection. 

10.REFUND POLICIES

You understand that Sinclairs Jewellers services will commence as soon as Sinclairs Jewellers receives and processes your initial payment. The shopper has the right to cancel within 14 calendar days of their contract with us. The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model Sinclairs Jewellers Returns form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning
your exercise of the right to cancel before the cancellation period has expired. We will communicate to you an acknowledgement of receipt of such a cancellation on a durable medium (e.g. by e-mail) without delay.

If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

You shall send back the goods or hand them over to Sinclairs Jewellers, 63 Market Place, Inverurie, Aberdeenshire AB51 3PY without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods, however, if the item is not fit for purpose or does not match the original description then a full refund including return postage can be claimed. The Goods must be returned in perfect resaleable condition, including the original Presentation/Gift Boxes and documentation where applicable. We reserve the right not to refund or offer a partial refund on returned Goods that do not comply with the above.

We will make the reimbursement without undue delay, and not later than:
(a) 14 days after the day we receive back from you any goods supplied, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods

EXTENDED RETURNS PERIOD - CHRISTMAS 2017

Any gifts purchased online between 13/11/17 and 28/12/17 can be returned anytime before midnight on 15/01/18. Purchases made after 28/12/17 will be subject to our normal 14 day returns policy.

11.DELIVERIES

The delivery estimate for each order is stated at point of checkout with your selection of delivery method. We endeavour to process orders as soon as possible and the majority of our orders within UK mainland are delivered within 24 hours of being received, provided it is before the 3.00pm deadline. Please be aware that there may be rare circumstances where our shipping capacity may be exceeded and cause a delay of one extra day. We regret that this situation can occur and, should this occur, your order will be marked for urgent delivery the following day.

If you have recently placed an order and you think the delivery of your item/items is overdue, please contact us by e-mail info@sinclairsjewellers.co.uk or by telephone on 01467 620275. We use Royal Mail for the majority of our deliveries for reasons of reliability and convenience. Unfortunately, as with all delivery services, there are very rare circumstances where parcels do not arrive in the agreed timescale or they are lost completely. Under these circumstances, we endeavour to ensure that the item is delivered to you as soon as possible by contacting the delivery service and attempting to locate your parcel and have it delivered. Should you wish to contact the delivery service yourself we can supply the tracking number for your item by email.

In the event of a delay causing delivery not to be processed for next day then a notifying email will be sent. As we use a third party for deliveries we cannot be held responsible for late deliveries due to postal strikes, transport strikes and incidents such as flood, drought or severe snow. These circumstances are rare and we will do our very best to take responsibility and rectify the situation as quickly as possible. In the case of lost items, we cannot refund orders or send out a replacement until the delivery is confirmed to be lost. This must be confirmed by the delivery service themselves, and the time periods at which items can be confirmed lost depends on the delivery service used, and are detailed as follows:

  • Royal Mail Recorded Delivery / 1st class - 10 working days to confirm a lost parcel
  • Royal Mail Special Delivery - 5 working days to confirm a lost parcel

In all cases a full refund can be claimed if the goods ordered do not arrive within 30 days.

Due to the nature and value of our products all deliveries require a signature upon receipt. Please ensure that you inspect all packaging to check that it has not been tampered with in any way. If it does appear to have been tampered with, you should refuse delivery. If the delivery is accepted, you will have entered into a contract to accept the item in its delivered state and, as such, we cannot assume liability for any subsequent issues surrounding loss or damage. If there is no one at the address supplied at the time of delivery then your item(s) will be taken to the nearest Royal Mail or Fedex sorting centre, where it is YOUR responsibility to collect or arrange re-delivery. If you do not collect your items, or have them re-delivered, within 5 working days then your item(s) will then be sent back to Sinclairs Jewellers where you will have to pay for re-delivery.

12.BREAKAGES

Breakages must be reported on day of delivery, we recommend that parcels are opened at time of delivery and signed for. If goods are found to be damaged upon delivery please contact us on 01467 620275. In the unlikely event that you receive an item broken or faulty we will replace it Free of Charge.

13.GENERAL

You represent and warrant that:

  1. you are at least 18 years of age or the age required or allowed under applicable law for making a legal and binding contract;
  2. all information that you submit is true and accurate (including without limitation information relating to your Payment Method); and
  3. you are an individual (or in the case of an entity, an agent of the entity) authorised to use the designated Payment Method. You agree to pay for all charges (including charges by other persons) and to comply with your responsibilities and obligations as stated in this Agreement. If you are an agent of an entity user, you represent and warrant that you are duly authorised to legally bind the entity to all terms and conditions of this Agreement and that you have made the entity aware of them.
